Publication of the Amicus Curiae of our Attorney at Law, Dastid Pallaska, for the Constitutional Court in relation to the referral of the President of the Republic for the assessment of compatibility with the Constitution of the General Principles

On 1 December 2015 our Attorney at Law Dastid Pallaska – acting pursuant to the invitation of the Constitutional Court – submitted an Amicus Curiae Brief in relation to Referral KO 130/15 of the President of the Republic of Kosovo by which the President of the Republic of Kosovo requested the “Interpretation of the compatibility of the General Principles/Main Elements of the Association/Community of Serb majority municipalities with the spirit of the Constitution, Article 3, paragraph 1, Chapter II and Chapter III of the Constitution of the Republic of Kosovo.”

In spite of the fact that the Amicus Curiae Brief is a public document and part of the case files of Referral KO 130/15, the same was not published until the issuance of the judgment of the Constitutional Court in relation to Referral KO 130/15 in order to prevent the abuse of the Amicus Curiae Brief as a tool for exerting pressure on the Constitutional Court during the review of Referral KO 130 by the Constitutional Court.

The original version of the Amicus Curiae Brief in English language can be found in this link, while for the translated version of the Amicus Curiae in Albanian language you can click here.
