Law on Geographic Indications and Names of Origin

On May 30, 2013, the Assembly of Kosovo adopted the Law No. 04/L-187 on Geographic Indications and Names of Origin. The law was published in the Official Gazette of the Republic of Kosovo on July 4, 2013 and is expected to enter into effect on July 19, 2013.

According to this law, a geographic indication is the name of a region, a specific place or in special cases the name of a state which is used to describe a specific product originating from that region or specific state and as a result of this it contains certain qualities, characteristics or reputation. Furthermore, the geographic indication implies the production, processing and preparation of the product at the defined geographical area.

This law foresees the registration of the geographical indications in the Kosovo Industrial Property Office and in this way it prevents the registration of products whose description could deceive the consumer regarding its geographical origin.

This law is based on the Directive 2004/48/EC of the European Parliament and of the Council dated April 29, 2004 on the enforcement of Intellectual Property Rights, TRIPS Agreements and Paris Convention for the protection of Intellectual Property Rights.
